A townhome is a single-family dwelling unit constructed in a series or group of attached units with property lines separating each unit. They are built as single or multi-story units, each with at least one separate outside entrance. A townhome is like a house in that the owner owns both the structure, and almost always, the land on which it sits which would be limited to the front and backyards. The townhome owner usually pays property taxes on their individual units. The ownership responsibility may have different circumstances from development to development as to who owns the outside walls, roof, etc., and should be verified before purchase. You cannot determine if a property is a condominium or a townhome by looking at it. Townhome owners are "usually" required to be members of a "Homeowner's Association" and are required to pay a monthly fee to the association to cover the cost of maintenance for the common outdoor areas, common area liability insurance, management fees, and possible pool, tennis courts, etc., upkeep.
You will want to ask for a copy of the "Declaration of Restrictive Covenants" which are recorded at the County Register of Deeds Office. The declaration describes the nature of the project and establishes rules to govern the use of units and common areas. Items that might be important to you are pet restrictions, installation of a satellite dish, parking and rental restrictions. If something is important to you, make sure you can do it.
Be sure there is a clear understanding of your unit ownership. The success of the townhome association is directly related to the caliber of the association. A homeowners' association, through its executive board, will often employ a management company to take care of maintenance, collect dues and assessments, and carry out day-to-day responsibilities of the association. If the association board of directors is functioning properly and has good legal counsel, then the entire community will be an exciting, desirable place to call home!
